Using content from other sites?

There is nothing bad in writing content which is inspired from other websites... but copying exact snippet and publishing it on your website is not accpetable. Google hates plagiarism and content stealing, so better stay away from it.

Is it legal to use no more than 5% of another site's content on your site?

Depends if they don't send you a warning via email. Had a similar situation when cloning two sentences from a website. After checking copyscape I knew why they sent it.
 
A website that consists of nothing but duplicate content from other sources which are quoted partially, with a link to the original post, and with a personally written intro explaining why you liked the post, video, whatever ... that kind of site does really well in Google and probably will continue doing well.

A site that is 100% duplicate content and no other added benefits, no unique descriptions, and without a backlink to original source -- won't do well in Google and will do even worse as time goes on.

Bigresource gets away with it somehow, but mahalo got away with it forever and look what happened to them. http://siteanalytics.compete.com/mahalo.com/ Even bigresource is at 40% the traffic they had pre-panda and all indications are that their traffic will keep falling.
