Urgent Help - Need ebay advice.

    Hi Folks
    Thought I'd sign up just to get your advice (that's how cool I am) so,

    I had an iphone that died about 3 months ago, iphone 3g lasted around 4 years... well past its date for burial. Great little phone , so

    I just purchased a new iphone 3g in " good condition , " for £130 from ebay,
    the advert states that the " vibration, " doesn't work but all other features are working.

    Problem -

    I can't be 100% sure the microphone works, the OS was slow (which I regard as a big feature, but then I downgraded personally to 3.1.3 (might upgrade later to something more recent but not 4.0 systems as they were what lagged it up)

    The cosmetic wear is to the case primarily, but there are scratches on the top glass.

    I messaged him, saying I wasn't happy blah blah , I then opened a case but he threatened to escalate it which in the eyes of my parents meant court so they advised me to close it... so I then send him a few disgruntled messages.

    I then hear my mum talking about sending it back via paypal and recorded tracking? so upon arrival the seller has to give me a refund (he stated on the advert, no refund applicable but apparently by law he can't do that and he can't keep using the " sold as seen, " argument against me as I have no physical proof of the condition i.e. the photographs could just be fake)

    To get it repaired its going to cost me £60 then + £30 for unlocking and topup to 3 network. I could just sell it to a shop that refurbishes them for £100 and just buy a blackberry curve 8520... but my iphone although its only 8gb (which ya know, its a bit of a downside) is so useful to me, even if it is slow at texting really.

    What do I do?

    i would sugest upgrading it to the latest firmware, was the iphone software unlocked ?

    or you could just resell it as is on ebay. cut your losses and move on. Hey that's the price we pay for our type of online transactions. Sometimes you lose a little. You could have went and bought a brand new phone and had no problems.
