Top 10 Channels - How do they get away with Copyright?

I know that late 2012, ealy 2013, there was a crackdown of any copyrighted channels and so forth but people have thrived quite well with Top 10 Channels but the pictures and video footage that they talk over isn't theres yet they are either partnered or affliated with YouTube somehow.

If anyone who does these kind of channels respond and let me know in detail. I am very curious (no pun intended)
