In a complaint filed Monday, Niece Waidhofer claims Thothub, Cloudflare, BangBros and Chaturbate should be held responsible for her nudes appearing on the "leaked content" site. - vice

It is interesting that the lawsuit includes Cloudflare since they are the infrastructure side of it and not the actor. Further, BangBros and Chaturbate just advertise on the platform. Thothub is the only improper actor of the group.

It would be like suing TV signal transmitter companies and the ads in between a TV show because the show producers leaked nudes or something. But sounds like that is just a negotiating stance and not a true legal argument.

I thought thothub gets its content from "egirls" who sent in the content themselves to get exposure. As it says in the their footer:

Cloudflare act the same way a host does. They are the ones serving the content.

I think they're just technically challenged. Cloudflare shouldn't be part of the suit lol.

Their legal team must roll their eyes every time they send a lawyer to court to deal with boomers that don't understand how technology works in the most basic sense with cases like this lol.

No it does not. They do serve content, but they don't host any of it.

A server which shares content to other servers or users is a host. Cloudflare distribute content from their own servers. They may not call themselves a hosting company but their servers are hosting content.

There will be no problem to Cloudfare because in agreement they must have declared.
According to their Abuse policy

"Cloudflare is not a website hosting provider, and we cannot remove material from the Internet that is hosted by others. "

"Cloudflare does not have the capability to remove content from a website hosted by others. "

Maybe an unpopular take, but what was she expecting when she entered the adult industry? It's not all rainbows and sunshine for fucks sake, be prepared for your content to be hosted illegally anyway. Take down one, and another will appear.

Who have they made that agreement with?
Also, that means they can't remove it from the original host. It doesn't say anything about them being allowed to carry on distributing the content.

Would you expect someone who is distributing pirated content to say well someone else was distributing it im just helping them speed up the distribution process.

In a way you are correct but there is no way Cloudflare is gonna get blamed for that since it's illegal to search someone's files you are not hosting (even if u are hosting it i am pretty sure it's illegal without a proper reason, especially in Europe).

If someone reported the website and you didn't take action then you can get in trouble.
