Refuse to take action. Instagram will eventually take care of it, as any DMCA should be issued to them seeing as no one will have your information Block him and enjoy your traffic.

If you took the picture from Instagram, you need to check the terms of use of Instagram. As far as I know (but I may be wrong) once you post something on Instagram, the license for the image became free for non-commercial use.
About the lawsuit, he will need to pay for the lawyer and IMO no one will do that. But if he did, the court will still ask you to meet with his lawyer and get to an agreement before seeing a judge.
Bottom line, unless you took it from a company, nothing going to happened, you can have fun with him as much as you want and feel safe.
