This is true and in fact is written on webmaster central when you log in.

The part you are missing though is without original content you will not rank, or at the very least will rank badly.. Google's algo works nicely with fresh content this is clear from adding content and watching rankings..

It's abit of common sense really, what's going to rank better the site you ripped the material off that had the original content, or some site you've recently created which has nothing but duplicate content.

So yes in essence you aren't being penalised , but you're not being ranked.

What I'm getting from this is that we are not really doing the wrong thing by warning people of duplicate content.
If you must have duplicate content then make it a printed version? I will have to look into this, but, all in all, I figure we as SEO peeps should keep our duplicate content down to a minimum.

It's good to know this stuff, but as an SEO person, I really found this as common sense. I still won't use duplicate content personally.

Google doesn't consider moving you from top of the SERPS to bottom of the SERPS as a penalty either. They are very good at playing with words. If you think going from top 10 to bottom 3000 isn't a penalty then you have a good understanding of Google vocabulary. Most people would consider such a drop in ranking as a penalty but not Google. The only thing Google recognizes as a penalty is a ban from their search engine. I beg to differ.
