Terms and Conditions in a Foreign Language

If I visit a website and they just have their TOS pasted on the page in a banner (no click to accept or agree or anything like that) and the banner is in a foreign language. Is that TOS enforceable from a legal stand point (baring the cost and legal logistics of suing someone in a foreign country)?
