Yes, he made a mistake and it can be argued that it was a negligence but people that used his API keys are basically ones that stole, not him. Because they took something that was not there's and abused it.
tough call really, but $55k is not a small amount, either. Have I heard google sue locally anyone in Georgia? No. But again $55k is no small money.

But from standpoint of court I see decision going for google........as sad as it sounds. He published something publicly, and it's his negligence.
