Static Links such as Whois for Tier 2 and below?

Hi all, I couldn't find any information on this, but I use GSA SER to build some of my tier 2 and below backlinks. I've been told using static links such as Whois links is bad for tier 1, but is it acceptable for tier 2 and below? Thanks!
