This man is smart.
Here's an off the wall idea.
Your products just been devalued, so if people buy his first then yours who gets the complaints ?
You need to either A) mass market the thing and sell it before he sells his, or B) build a reputation that knocks him into the ground.
Here is an off the wall idea.
Release the thing for free - and first page open a sales letter that tells your readers that you are the original author and he's a fake. so to protect your rep you give it away for free and warn against his piece of shit. build a mailing list and you have a customer base at his expense.. also a reputation for shifting a quality product ( i assume ), and giving something away for free.

It's a great idea if you can really compile a list of buyers at his expense, equally you gotta play it very smart not to advertise his existance in the attempt to spite him. I presume that his marketing sucks and it is not worth bringing him to people's attention.
The claim that someone ripped you off & that is why you are doing X works to give you credibility though.

If this is the only product idea your ever going to have... then fight like hell.
Otherwise, move on.
This forum and others like it are filled with products that many people worked hard to develop and promote, while I, and many others have found back doors to get them for free.
I do mainly white hat, but I am so glad to have found this forum and am learning the black, if only to protect my projects the best I can. But when my time comes, and it will, if something gets posted that I worked hard on...que sera sera.
Take some of the positive suggestions from here and put them to use, and I include it a positive to trash the hell out of the guy or even hiring a gunslinger.
But keep moving, and you'll be fine.
Otherwise, move on.
