Well, I don't know about the court thing but I would say you can file down DMCA notice in google, hosting company and their registerer. They will take it down and for google there will be (taken because DMCA notic message)

You might also use some Negative SEO to get them out of the Radar fast while working on the other things

Finally, I heard this story, A LOT! looks like its a new trend to just clone other people website. It's pretty easy btw to clone anyone website and I don't have to enter your directory or hack your site to get it
 
OK, first of all it doesn't matter if you contact Google or send him DMCA notice or in whatever way you want to threat him.
The thing is he has all the files and content with him, you take down 1 of his website, he will build another 10. So you see it's just a waste of time.
So, its worthless to chase after him, you have a good thing going on, so just stay on it. Keep on promoting your own blog/site and keep earning :)

They probably thought about you doing a DMCA complaint and it's probably hosted on a off-shore host.I'd go after their source of traffic :)
 
If that true then why do you see the DMCA takedown notices in the google search results when looking for torrents, with the reference to "chilling effects" etc...? What's the difference between Google getting involved in those cases, and Google NOT getting involved in this one?

The 'chilling effects' that you're referring to is the domain name of the website that usually pops up at the top of G when you do a search for DMCA. It's not actually referring to the effects that filling a DMCA has on it's recipient.

I had some clown file a false DMCA on my site which had a legitamate review of his product and God awful, shitty 'customer service'.

Basically the guy was an ass wipe and I merely reported word for word what he said. He got his panties in a bunch and filed a DMCA alleging copyright infringement because I'd used the name of his product in a review of his product :)

it happens....move on.....just kidding be careful about doing the google dmca, i did it once they fucked both sites over. Took me a year to get it back and that was with a 301 redirect....
