Snagging domains for upcoming trademarks

Sorry if this isnt posted in the right area

So i've done some looking into this but im not sure if its "illegal" Ive thought about doing public queries online for people trying to get names trademarked, then i go to see if the name theyre trying to trademark has a TLD or not, primarily .com
So for example i see someone is trying to trademark the name xyz, then i see if xyz.com is taken. If its available i buy it then turn around and post it for sale and wait. Thoughts on this? Good idea or bad idea

I fell into this trap with my 1st trademarked brand name.
I threatened with cease and desist letters among other attempts of hostile communication.
In the end , going through the process to get the domain back under these circumstances costs a minimum of $1000 because the dispute must be resolved by arbitration. Which is some kind of specialized lawyer = 1 person decides type of deal.
I think it is technically possible for judgement to be passed to where the Trademark infringement retributions could bring you into negative profit territory. Which have no doubt about it , this can easily be shown to be trademark infringement. In my case after some critical thinking i opted out of taking legal action for multiple reasons. 1. The costs to take legal action would be equivalent to just paying the owner for the domain. 2. The owner probably doesn't have money even if i were to land a favorable judgement = considering the grimy nature of this method. 3. The time value of going through the legal process. 4. The implications of the "offender" being overseas / International law making it possibly more complex than expected.

I'm not a lawyer. Just have experience with this.
I'd say that technically speaking it is illegal.
But it would be rare that you would end up penalized for the reasons i provided above.

yeah its illegal but if it makes you feel good, go for it :D
don't ask for too much of a markup, keep it in the high three- low four figures
 
At the moment i have 14 .com domains pertaining to names people are trying to trademark. I only have them parked so they arent being monetized at all. Im selling them all at $500 each, so it isnt a crazy high mark up. Its just enough to the point where it would be easier just to pay it then go into legal disputes. It is pretty sleazy, ill admit.
