You are correct, sorry for my lacking precision English is not my native language. However, "the ability to sue" is the result of a legal system (laws) that supports the idea of suing for damages. So while copyright infringement (might) not break the wording of the law it surely conflicts with the legal rights of the copyright owner and those rights are secured by law. Thus I believe my point still stands.
