Sites that should have been effected by Penguin but aren't

Has any else noticed that the Penguin update is very inconsistent? I've seen websites for keywords, that have link profiles that are full of blog/forum comment links, and also 100's of exact anchor text matches. To the point where if you were to analyse a site, their backlinks, their on page and try and follow a similar strategy, you are in theory doing exactly what Penguin is clamping down on?

Any thoughts on this? Im basing this on what I have read around this forum with regards to where Penguin has apparently hit sites the hardest.

Links might have been disavowed in Google Webmaster Tools, that way they are still visible in Ahrefs and Majestic for example, although Google doesn't take them into consideration.

Google always miss by long range in on penalties who use backhat techniques, no wonder why BHW have the most active SEO services if compared to any webmaster forums

I have read on some post here that spam websites retain their rankings. How true is this?

I can attest that some sites that use 100% scrapped content still be the king, while sites that get their content stolen ranks below this loser.

All Google updates are inconsistent, and unfair, and illogical....that's what happens when value is determined by an algorithm, however complicated it is made out to be.

Try not to overgeneralise your strategies - for example, how many exact match anchors do you think ebay gets? Or amazon? Millions! That doesn't mean they're spammy links. Use logic not statistics when strategising.
