SITE Took my company name

    I have a company with a site lets say mycompanyname ., another site popped out with same name but put an inc after domain, so they registered mycompanynameinc , im incorporated their not, its in same state, what do i do to , there doing same business as me, how do i take control?

    If it is in the same state, your state registration office made a mistake.

    Is your company registered and active? Are they a DBA or you?

    Contact your state to get the specifics of the issue. In my state, they would not allow that as they are too simular but I know of a few times it has happened.

    How long have you been in business?

    You do not have to have a registered trademark to file a compliment and win in court as long as you can prove you've been in business and operating for a period of time.

    Without a trademark though the cost and onus is on you to bring suit.

    OP - Contact your state registration office. You are going to hear a lot of theories and very few facts. Most guys here are not in your state and those that are couldn't tell you the state laws because they have not had to form a corporation.

    Free advise is great but in this case, you get what you pay for it.

    Go to the source of the issue as it is their responsibility - not yours and time of business does not matter.

    Hang on the problem is domain name, not co reg. So why don't you go to their registrar, provide links to your incorporation registration, and file a complaint with them (I don't think you even need a lawyer). Then see what registrar says.

    noooo lol , i have the inc , they dont , but they took my name , seocompany and make seocompanyinc lol but they are not incorporated!! i am

    OK, It is odd I just had the exact same thing happen. Searched the domain, it was open. Filed the paperwork with the state. Before I got my site up.....domain taken. It will teach me to get the domain asap if it is open.

    I have some cease and desist letters from ebay i think in my spam... fwd one of them over and see if you get a response... offer him to settle right now out of court for $$$ or else say you will sue + make him liable for your attorney fees when you hand him his butt in court.

    yeah i mean its like making a search engine website called googleinc.com , when google.com is owned and incorporated already
