I have site recently penalized for unnatural links. I'm going to to start a new site. Can I reuse the content in the penalized sites? If so do I need to 301 the original posts to the new site? Will that "transfer " the penalty to the new site?

Just no index your old site and then remove the content and add it to your new site!

Spintax them and use them as article directory submissions to your new site that has fresh content.

Depends on your original content. Was it indexed?

You can indeed no-index your old site, but if you want to get really paranoid, I'd do two things:
- repurpose the original posts from the penalized site and turn them into presentations and videos and post them around
- rewrite the orignal articles so they pass copyscape and post them on your new site (make sure to really rewrite the titles perfectly)

Just my 2c :)

I had a site penalized back in October so I just requested for the old domain to be deindexed in WMT . I transferred the whole site to a new domain and built some better backlinks, then deleted the old site, it's now ranking fine again.

Both flavours of suggestions are really good but I think it depends on the quality you feel you have.

If it's top notch stuff reuse it straight to next site, if not spin it and distribute it out.

Yeh like the otheres said take your original site offline and just upload the content on to a new domain and start over.
