Should I file for bankruptcy?

I was on a bike & got hit by a car, I just got a letter in the mail from the surgery on my leg it is over $57,000.. I applied for social security but was denied & am trying to get some government assistance to cut the cost does anyone know how much they can take off the bill, I need some advice on what I should do I am :owned::eek:
 
Are they garnishing your wages or some such thing to pay off the medical bill? Don't even think about filing for bankruptcy if they have not yet sued you, won a judgement, and they are collecting on said judgement. Bankruptcy is not free and is only a last resort if you have no other options left to you. Otherwise, since it seems like you have little to no income coming in you're essentially judgement proof. Hope this helps.
 
Just wait it out. Do not file 7, 11 or 13. Wait until the calls start coming (if they have not already) you will be able to settle probably for 50% or more of the costs. THen you can work out a payment structure with them, x amount for x time.
 
Too bad you don't live in Canada. We don't have those type of issues here. It's all covered. Anyway, good luck with your debt and your leg.
 
Depending on income and assets, you may file chapter 7 or 11.
7 Would wipe out all debt and you can actually get a lawyer to file for you for 1k or less, just check craigslist.
If don't have many assets and low income, apply for Medicaid.

If you do plan on filing chapter 7, be sure to include All your debt because you cannot file again for 8 years or something.

Don't be in a hurry to file bankruptcy, you never know if something else may pop up that you will want to include. Work on getting income and an insurance plan for sure.
 
May I ask why the person who hit you's insurance isn't responsible for your care?
 
I assume for some reason you can't sue the driver for damages. Most hospitals will work with to schedule a payment plan that works for you especially if you don't own property that they can apply a lien against. Also, you can get a tax deduction for large medical expenses so review all your options.
 
I am trying to sue the guy who hit me but it is not looking good, the first lawyer wouldn't take my case & he took a case where my friend got hit by a car on the sidewalk..

I paid $2,000 for the other lawyer he said it is going to be a hard case, I don't have a job my work shut down after my boss got put in a coma from a jet ski accident so I have no income.. the driver left the scene of the crash but came back I don't see how I am at fault but according to the police report I am. I looked both ways before crossing the road didn't even see the guy who hit me. I just remember waking up in the hospital with a concussion. I got two citations I just went to court, for making a left turn or something & not having reflectors on my bike even tho it was still pretty light out. There was two witnesses to the crash but neither want to cooperate & have anything to do with it. Storming pretty bad out here right now a tornado is heading our way I hope my day doesn't get any worse.
 
ryp, ignore any ignorant comments about bankruptcy. I just filed bankruptcy and my credit score went up through the roof. I now have a 790 FICO score with a BK on my record, and get the lowest interest rates for anything I want to buy.

As a side note, Blue Cross Blue Shield should be able to pay your bill if you can't afford it?
 
I don't understand why an attorney wouldn't work on a contingency basis with you. Plus the driver did hit you so you should pursue his insurance company. If you are experiencing tornadoes you are out in the Midwest near Chicago based on today's weather. In any case check in with Social Services and check on your disability insurance if applicable.
 
Yeah I am in the midwest area in Ohio, applied for social security but both kinds were denied, the lady who I am working with on getting my bills reduced said this would happen & I should appeal them which I am doing right now. I just don't understand how all these people can get disability / social security when they don't need it as much as I do, even if I wanted a job I could not get one because I am injured for not sure around 6 months my Drs were saying it could be for a year, but now the social security people are saying I cant get assistance because I will not be disabled for a year. This is so confusing I guess I just have to wait it out until I hear more from the lady I am working with to get costs reduced & from my lawyer. Just needed to vent I guess today sucks
