It's possible, does the person know that they're getting a copy or do they think they're getting the original? If they don't know they'll get pissed and call ebay, you'll lose the money and you might get your account suspended. This is a really stupid thing to do, if you paid $500 for adobe photo shop and instead you got sony dvd wouldn't you get pissed? If they're paying and expecting the original you really screwed up. And yes you can go to prison for this.
