Selling Replicas on EBay

Hi

I know there's been a few threads about this already but is there a legal way to sell replicas on EBay?

For example, if I explicitly state in the listing the item is a replica or non-genuine is this sufficient?

Further, if I sell an item that normally costs $1,000 for $200 can I assume the buyer knows it's not authentic or is it required for me to state this explicitly in the listing?

I know this is a tough subject so I am requesting that only those who really have experience in the matter reply. I further understand there is risk of account suspension by EBay/PP by selling replicas but in this thread I am not concerned about the accounts - only about the legal aspect of it..

Pretty much this! It's too risky. I sold replicas before and was one of the fortunate ones who didn't get caught, but I had a plan in place where I only did it for a month and then got out. And now I'm too scared to go back in with selling replicas. I sold about 100 items at about $50 profit per item, and about 10 of those buyers knew what I was doing and so I just refunded them their money, no questions asked and even let them keep the product.

So it's a definitely a game of chance if you're willing to play, but as those links above suggest, the answer to your question is "no" even though people continuously still sell replicas on eBay.

It was time for me to get out at that point because I didn't want them alerting eBay and filing complaints and stuff like that to get my account closed down.

I'm actually researching on how I can go about becoming an authorized reseller for several of the items I was selling as replicas. And then I'll just need to sell more to make the same kind of money was making with the knockoffs.

I was thinking about this last week, it's tempting because of the money, and I have seen people doing it, so there has to be a way. However, if you get a proper jobs worth customer, the one that is holier than thou, then you could end up been sued, arrested, or whatever.

Thats one thing that always puts me off, is that I can't be bothered to go through all that drama. People who have done it, and got caught, always seem to be glad the drama is over.

Like above said, it's a game of chance I think. Are you willing to roll the dice on your freedom ?

You can't legally sell replicas in any way, shape, or form. Disclosing that it's a replica does not protect you, and no, pricing the product at a low price does not give you immunity either.

I was into replicas a few years ago and it's easy money, but it's also very stressful and not sustainable unless you want to make replicas and eBay your "thing". I was *always* worried about sending off a poor product and getting that negative feedback - no fun in that.

I will say that the money was decent and the payday from selling my eBay account with thousands of positive feedback was huge. (Can't talk about that on BHW though.)

Our responses did target the specific questions. If you know about eBay's TOS you would know that selling replicas is strictly forbidden, no matter how you word or price something. If you looked at the BHW thread I linked you to, you would see stories of users who sold replicas and reaped the consequences of their actions. One of them actually got sued for selling replicas. Withatwist even listed their own experience with selling replicas on eBay.

If you can't read and comprehend information given to you to answer your questions, I feel bad for you. You shouldn't be attempting to sell anything online.

Ebay will ban you and the original owners may take legal action. Ebay is pretty hot on this stuff. I sold a bag on behalf of a friend on ebay and thought it was genuine, however the buyer seemed to know more about it than i did and made a complaint to ebay, i got a warning and had to refund the money. I got the back back and sold it offline instead. You could set up your own e-commerce store and sell them directly, as long as they are not fake but " in the style of " a certain type of product. There are some big online retailers that do it with fashion.

I say it is very risky as well. But I do know that people are doing it. Most would have to know that if the price is too good to be true, it can not be real but there are some ignorant people out there.

I think the company ASOS " As seen on screen " does it with fashion, not fakes but they copy the design and get it out fast after someone like Kate Middleton wears something. I think it's a close they can get without legal action

only way is to use stealth accounts and take the money and run with each account... not my type of thing though.... very stressful and unreliable.

I have stealth accounts that are alive from 2007 so your milage may vary

Find someother else to do, this is a big cat and mouse game and youll get exhausted opening new accounts because its something ebay for a long time frowns deeply upon.
