Selling Instagram Followers Now Illegal

It is now illegal to sell followers.

What do you guys think?

The lawsuit was filed because of deceptive advertising.

wtf.... haha well now we will see " real " following accounts

I think this is mostly focusing on Devumi rather than fake followers in itself.

They have been hammering Devumi down because of the attention it caught during the last year.
Since it was located in the US, filing these lawsuits are much easier. Now people are just trying to get a piece of the pie.

I was also curious about this? I am considering opening a LLC in the US, selling social media engagement. I am going to be reselling followers from panels , I was wondering if it is illegal to do this? What if I specify they aren't real people on my website? Also what if I offer both real and fake, because I do know that some panels do offer genuine real followers at a higher price. What do you guys think? Any tips/suggestions?

At this point, it depends what state you are in and your client is in, honestly it's a better time to get out of that business then get into it.

This New York State case from over a year ago yes this is a very old post LOL was not the first either, a man in Italy got sentenced to 9 years in Italian prison even before that New York ruling in January of 2019 behind fake TripAdvisor reviews for a restaurant that didn't exist.

Not long before that, Amazon went on a rampage suing individual Fiverr sellers for fake reviews and tried to have criminal charges pressed in addition to the civil suits it was filing against those sellers.

Like I said, good time to exit that vertical. Maybe look into creating somewhat of a spin on the idea, likely would involve more Hands-On activity than those useless zombie follower accounts would, but it would probably be safer and actually provide a benefit to your customer. Everyone knows that fake followers from zombie accounts that never engage with anything contribute absolutely nothing a value whatsoever.

They don't even do anything for boosting your profile or SEO because the algorithms are smarter than that by now and they actually look for engagements from them.

Follows alone will do nothing. Shares 2 sea of dead accounts do nothing. both of those statements are equally true whether you're talking about 5 followers or shaes or 5M followers or shares.

What they actually look for is whether or not those followers are liking sharing and commenting on your posts, and whether those shares of your link resulted in likes chairs comments etc.

TL;DR: late to the party, not worth it to risk legal and financial hardship behind selling a worthless service that is also a low ticket item.

As written in the article, selling fake followers and fake likes /engagement provides deceptive endorsements.

When someone sees a post they like, they endorse that post by "liking" it. When people see a post with 1,000 likes it seems more credible and has "community endorsement". Doing this artificially is deceptive. Especially if it is for a paid product promotion or affiliate post.

Again, according to the article, this is the first time this has been successfully punished by law enforcement.

In this case it was an agreed settlement.

If the company didn't settle would this be a non-criminal action where the ag goes after monetary damages? Or is it it possible the ag could make it a criminal action?

Not to be a know-it-all but I have to correct the article LOL prior to that, an Italian Court sentenced a man to nine years in prison for writing fake TripAdvisor reviews for a non-existent restaurant. Although this was the first time it was successfully prosecuted in the United States.

That being said, the way the legal system in the United States works is that once a precedent is set by a ruling like this, it becomes the new standard approach to any such case unless of course it is overturned at a higher Court.

In other words don't get your cocky if you're still selling IG crap lol

TLDR don't sell f@ke things if you are in US.

Who cares?
As said just dont do it in the US or hide it. People are out here selling copyrighted everything, if Disney, Pixar Hollywood etc arent shutting them down and suing them you can handle this.

You are right, problem arises when someone starts doing all this on large scale.
