I was also curious about this? I am considering opening a LLC in the US, selling social media engagement. I am going to be reselling followers from panels , I was wondering if it is illegal to do this? What if I specify they aren't real people on my website? Also what if I offer both real and fake, because I do know that some panels do offer genuine real followers at a higher price. What do you guys think? Any tips/suggestions?
The lawsuit was filed because of deceptive advertising.
They define selling followers as deceptive advertising.
As written in the article, selling fake followers and fake likes /engagement provides deceptive endorsements.
When someone sees a post they like, they endorse that post by "liking" it. When people see a post with 1,000 likes it seems more credible and has "community endorsement". Doing this artificially is deceptive. Especially if it is for a paid product promotion or affiliate post.
Again, according to the article, this is the first time this has been successfully punished by law enforcement.
In this case it was an agreed settlement.
If the company didn't settle would this be a non-criminal action where the ag goes after monetary damages? Or is it it possible the ag could make it a criminal action?

You are right, problem arises when someone starts doing all this on large scale.Who cares?
As said just dont do it in the US or hide it. People are out here selling copyrighted everything, if Disney, Pixar Hollywood etc arent shutting them down and suing them you can handle this.
