Selling Digital Goods Workaround (MC999)

Has anyone had success selling digital goods by installing them on USB drives or DVDs and shipping them as physical copies? For example I used to see a lot of people selling student versions of software on ebay and they would ship the product keys via e-mail but ebay has pretty much banned anyone trying to do this anymore.

And if the company's software agreement states: "...it may not be used for commercial or for-profit purposes, as more fully described in the License and Services Agreement.", how much trouble would you get into if you violated that rule or ToS - could they press legal charges against you?
 
If you violate it once, you'll be fine. If you violate it twice, you'll get banned.

Haven't ran into anyone that ran into any charges for listing VEROs or digital goods.
 
digital goods are never a good idea you will get banned sooner or later
