Ringless, Voice Broadcasting Lead Gen. HELP??

So I have done many hours of due diligence when it comes to the lead marketing tactic of Ringless VoiceMail and Broadcasts. I am interested in utilizing this path for my own business leads, but also to be able and try to make a little on the side offering specific niche leads to other businesses.

Now, the several pieces of software and online platforms I have come across all look great, But I really need help as I am stuck in "analysis Paralysis" lol....

So far I am leaning towards ringlessleads because of the low cost per delivered voicemail and the company provides a lead scrapper/Data-miner.

I also like the Automatic Lead Tools paired with the Ring Central platform. However It may be a bit pricey.

A few others are.... GoRingless, iBuzzPro, Callfire, slybroadcast,lavaleads,and dialogtech, just to name a few(too many I know).

To put it as basic as I can, I am not looking to start up a large call center or anything of that nature. An All-in-one platform that I would probably end up splitting 50/50 between utilizing the software for my own business leads, and the other half offering the service to other select people for their business would be Ideal!! But I know nothing ever works out that easy, atleast for me.

So please BHW members, help steer me in the right direction so I can get "unstuck" and move forward?

Friendly word of advice: Abort now!

If you are trying to use ringless voicemail or voice broadcasts, and you are in the states or calling anyone in the states YOU WILL GET SUED. It violates the TCPA and someone like me will sue someone like you.

It may not be today, it may not be tomorrow, but eventually, you'll run into someone like and you'll find out that the "low cost per call" is actually around $500-1500 per call. Its a really bad idea. Don't do it. You have been warned.

If he had bothered to do any reseearch at all before making such a sweeping statement, he would have discovered that ringless voicemail drops are not regulated in the same way and DO NO violate TCPA. He is welcome to try suing someone who may leave him one someday, but it will be to no avail.

In fact, voicemail drops are the ONLY way to broadcast your message without the risk of being sued. They are 100% FCC compiant and a very good idea. They are non-intrusive, the recipients phone never rings and there is no cost or inconvenience to the recipient.

As to which platform to use - I have no idea really. I'm in pretty much the same quandry and am inclined to 'suck it and see'. Just make sure that whichever platform you try they have no minimum call spend or contracts involved. Then you can switch them around and try until you find one that suits.
 
I've looked into automatic leads tool before and there are several reviews that made it sound like the data mining software doesn't work very well. A lot of the reviews claimed that there are cheaper scrapers out there that do the same thing and actually work. I know you should take reviews with a grain of salt, but the MLM component of automatic leads tool makes me more skeptical in the first place.

I've done plenty of research on the TCPA to include actual application of it in court. Ringless voicedrops are calls to a cell phone using a pre-recorded message. It's your money, you do what you want. When you are a defendant in a 10 million dollar class action case, don't say you weren't warned.

You show me a court case where a court has stated that ringless voicedrops are legal.

Here's a better question, if Ringless voicemails are so legit and legal, why haven't the legions of companies getting sued left and right across the country for TCPA violations using them?

Just because the FCC won't beat you up under the TSR doesn't mean a private citizen will do the same under the TCPA. These are two different laws.

I appreciate all the advice thus far! I will have to look into more detail regarding the TCPA and their regulations. From what I understand, as long as the prerecorded RingLess voicemail message is sent to the business owners Cell Phone only, then you are fine. Its when you use this method and send to the businesses main line that crosses the line into the FCC rules.

I will update for those interested in knowing how certain platforms I try workout? And please keep any additional advice coming in! Thanks

Who is telling you this stuff and are they willing to indemnify you in the extremely likely event that you get sued? If it is "so compliant" wouldn't they be willing to indemnify and defend you in the case of a regulatory action or lawsuit?

What is their source for this information? Do you or they have an insurance policy that will cover you if you get sued? What are you going to do if you get hit with a 50M lawsuit for illegal telemarketing, regardless of if you are right or wrong?

Its when you use this method and send to the businesses main line that crosses the line into the FCC rules.

You should be more worried about class action lawyers or a pissed off consumer than the FCC.

This guy is a clown...he knows zero. It doesnt surprise me though that he would rat on you for sending a ringless VM. He would probably have started spamhaus if the doosher that originally started it had been successful at being a lawyer. Most people shit on anything they dont know anything about. USC please send me reports of where rignless VM has been at the root of an issue and someone was fined. If anythign they were fined for not running the list through DNC.

From a legal website and like i stated in one of my other posts, if you arent compliant with the already established laws in place then you can get in trouble. Like email and the can spam, the call center and DNC, and calling cell phones are with the TCPA.
"The ruling was enlightening because the FTC chose its words very carefully to state that it does not matter where the transmission was targeted (i.e., a land-line phone or device). In fact, the FTC underlined the issue in a post to its web site, writing ‘Regardless of the means you choose — mail, phone, text, or something else — the law applies across the board.'



Thus, the FTC's policy going forward is relatively clear: There will be no tolerance for "loopholes" regarding text messages or so-called "ringless voicemail" messages that bypass a mobile phone's ringer and allow direct recording to voicemail. The FTC clearly intends to regard any communication without clear and prominent disclosure as a violation of the FDCPA and/or the TCPA.

Ahhhh - 47 can't show you a court case where a court has stated that ringless voicedrops are legal because it's never been to court. Hasn't been able to create the necessary interruptions/upsets because it doesn't interrupt. On your "better question if it's so legit why haven't the legions of companies getting sued use it." I have asked the same question. Since being involved with the inventor David King over five years now - and watched debt collectors consolidate or go out of business before their lawyers would let them use it. Watching the big four student loan servicers stop using the service for no reason, and their legal team was just scared. Yet the same legal team approved voice broadcasting the got Sallie Mae in trouble years ago - but wouldn't do ringless. The same legal team approved blatent violations of threat communications, misrepresentations on who they were, threatening to put consumers in jail for not paying, expired debt letters etc - which are now costing those companies millions of dollars for their shady deeds. Yet ringless voicemail keeps plugging along, making businesses tons of money, quietly, discretely, respectfully delivering informational messaging. It's been an interesting ride - Bob
