Yes you can. But I belive you need to do some minor editing to te pictures you want to upload. You have to do it so the hashes dont match with the original picture.

Well, there is also the risk of the picture being flagged I guess.

You are not allowed to use pictures without owning the copyright / asking for permission (except for public domain and cc photos of course) - simple as that.
The copyright owner could of course report your picture which might result in a ban.

I wouldn't use scraped content if you cannot endure losing that account.

Instagram is filled with like 90% recycled photos, the chance of owner of photos going after EVERYONE using their photos is so slim.
Yes, you can use scraped photos, or you can atleast credit them if it's from a photographer or someone personal.
If it's from big pages 100k+, chances are they are using recycled content, so you can use with low risk of ban.

Also another tip, you can add email and some text in bio like "Credits go to rightful owners, email to remove post, blah blah,"
