Question about eBay images policy

eBay picture policy states that using any borders or artwork on images is prohibited (see image 2,3).

if i added this photo (image 1) as a secondary image in my listing's 12 photos,

1)will it be considered as artwork and get punished by the eBay algorithm?

2)even though i haven't added any borders to the image, will the circle borders in the image be considered as borders by the algorithm?

please let me know if any questions are unclear. Any information or opinions would be really appreciated. Thank you..

Message them and see what they say. That way you can’t get in trouble.
I know they stopped people putting text on pictures are they was putting their website and making eBay lose customers.
 
I think it really depends on how trusted the ebay account is.

I've seen people put all sorts of sale text and graphics on their images, with no issues. Maybe because they had a 10 year old account and 100% positive feedback?
 
text on main image is definite no-no for new accounts...i was thinking using this image as a secondary image in my listing..but my account is only 3 months old..
so it's probably not worth the risk right?
 
mostly those rules is for 1 picture. Lets say if you add instructions in pictures , it is not being punished. However, i think that it depends on your account trust
