Now i made this site with privacy policy a year ago, its probably same like at least a few 1000 sites have, so duplicate content for sure. and its ranking better than my homepage right now. so i was thinking G must have screw it up with new algo
 
Firstly you should be noindexing your Privacy Policy. Secondly when google ranks a different page it could mean your homepage was hit with an algo penalty.

You do not want to noindex it, you want to no-follow the internal links to it.
 
I find Google makes this error all to often, I always add the NoIndex meta tag to this page. I find it doesn't negatively impact rankings, but prevents it from over taking your home page in the SERPs.
 
i gotta say it makes sense to use nofollow links to it

im not too sure about not indexing it

perhaps some more opinions???
