You don't get sued off the bat for something like this, you'll get a contact, then another, then maybe contact from a lawyer, and maybe an email cease and desist, but until your host talks to you or you get something in the mail, it's not really anything. A TOS is not legally binding unless it proves it is, and depending on where servers or you are located, it might be out of jurisdiction.

Further, I'd be surprised if they would ever sue anyone, because that would just open up so many doors for legal investigation into their practices again.
