Owning/Operating Warez Linking Site

I use the iPhone and I just recently came across a community forum that shares these apps by warez linking. Being a webmaster, I was just curious about somethings that maybe some people can clarify or talk about.

-If the host is in US but purchase a host in NL or another country where the laws are not as concrete, how liable is the site owner?
-These warez sites usually use ADs for profit, but can't a lawyer just contact the ad network and get your information? Thus revealing you are in the US and coming after you?
-Is OffShore hosting that secure for warez anymore? I've seen the US take down gambling sites that are overseas and those gambling sites have tons of money and can't even protect themselves.

In quick, is warez linking a smart idea anymore? I entertained it a bit a few years back but haven't looked into much. Its making me a bit more curious about how some people run their sites so they don't get caught.

register your domain with moniker and your host with some offshore host and do not care for anything else .

The key on those wares sites is the external hosting, they usually upload anonymously to external filesharing sites and add a disclaimer to the site "No software is hosted on our server" or smth like that

Can't they track you by sending a subpoena to the ad network company?

I read that US made some act about linking, from oct-5, and they want some uk student who owned linking site to come to US so they can trial him!! wtf
