Ok, I may be in the wrong section so if I am, please forgive my idiocy.

I have a site that has the name of a company in it that generates about 1,500.00 USD in adsense from organic traffic only.

The company sent me an email telling me that I have to give the site up as it is a trademark infringement. I am aware of the infringement and would like to keep the site earning for me.

    2 questions please:

    1) If I host it offshore will I be able to keep the domain?
    2) Will Google care that I ave adsense on a site such as that?

It's a good earner and I did enough SEO that it is on page 1 of google
and generates nice targeted traffic and of course makes us money so
I wold like to keep the site if possible.

The site name is companynameniche.com so I am hosed if I continue to host it in the USA.

You could move it to an offshore host and registrar (at your own risk seeing as you already have the C&D)... but you will lose your Adsense account if you decide to continue infringing offshore or not.

Dang... I was hoping that adsense would not be an issue... maybe I could redirect the site to another site in a similar arena?

    Perhaps sell it?

Basically if they've taken the effort to contact you regarding infringing their trademark they will likely do the same to any advertiser you have on the site (I've been there, done that, got the angry letters/calls from a hot lawyer lol).

Can't really sell it either unless you find someone who wants to take on the risk.

I would advise contacting a lawyer or just give it up and chalk one in the loss column.

Looks like I'll be giving it up.. I know it was a risk but considering I have about 20.00 in expenses and it has generated some real nice cash I came out on top.

I have 10 days to respond so I'll drag it out as much as possible before giving it up.

Santa has some other ways to make my Christmas merry.

As usual, thanks, Meathead, for your help... I owe you some beers.

What you could do is 301 it to a new domain (non-infringing) after a few months and just leave it blank for now.

Then just tell the company you have given up the domain and let it drop (and of course renew it). They will probably forget about it and the link juice you get from the redirect should rank your new site quite quickly (from what I understand anyway).

301 it to an unrelated site, doesn't have to be commercial. Then (in a couple of weeks, months) register a similar domain like the first one but not with your name and in some other, preferably less regulated country, 301 the unrelated site to use the juice, make money until caught again (may never happen).

    Check this post:

    EDIT:
Ups, Meathead was faster. I just wouldn't reuse it to make money directly which otherwise would mean not honoring the C&D.
