New Copyright Law Will Kill YouTube Compilation Videos?

Hey guys! So I launched a YouTube Channel recently with videos that are based around monetizing re-used content in a fair use way. So I'm basically using the same strategy that a lot of you have talked about of mashing up Compilation or Countdown Videos and reusing copyrighted content in an "educational" way so it's able to be monetized and isn't breaking copyright rules on YouTube (This includes your own Voice-Overs and Original Scripts of course).

However, this new law just rolled out in the USA is saying that they you can now get a felony charge if you use copyrighted material in your YouTube/Twitch videos (If this law passes). So does this new law completely over-ride the entire Fair Use laws altogether and will make it nearly impossible to do this method?

Is this Compilation Video method now too risky to even try? Especially if YouTube tightens their Monetization Rules and won't accept anyone who re-uses content even if it's considered fair use. My videos do have Voice-Overs and original Scripts though and I'm just reusing short clips and images from other Companies (Less than 5 seconds). However, the videos I'm planning to use are from really big Companies, so I'm a bit sketched out (Although there's dozens of Channels doing these methods already and doing it in "fair use" from what I can see).

YouTube does not make fair use judgements. They never have. Only a court can do that.

If YouTube gets a copyright violation request from the rights holder, they act on it no matter the context.

If your videos are fair use, and fair use has always meant "non commercial use", then you are not affected by this. You aren't going to jail without a charge and a court appearance where you have an opportunity to show fair use.

Fair use is non-commercial commentary, criticism, parody and education.

Using clip compilations with your own voice over on a monitized channel has never been fair use.

I haven't read the proposed law, but people who did, came to different conclusions than the video poster. These are comments from under the video you posted:
"...the bill isnt to target streamers its been changed to target illegal streaming sites and sources..."

People, including Charlie (the video poster), are being absolute dumbass fuckers who haven't read the proposed law and just go wild with speculation based on what some dumbasses who can't read have said. It literally only targets services where the primary purpose is streaming copyrighted content without the right to, or where the only commercially significant purpose is to stream copyrighted content without the right to, or where a site is being marketed for the purposes of streaming copyrighted content."

So if you haven't read the proposed law yourself, do it. Probably you'll be able to come to the same conclusions as these commenters and not to the conclusions in the video.

Thanks for the info! How are those big Top 10 Channels getting away with this then? Cause some of these channels have been doing this for years with millions of subscribers and they're pulling in like 500,000 views per day and it's monetized. Are they just running the risk of using video clips from Disney, Kim Kardashian, Dragon Ball, etc. and then just waiting for the Copyright Strikes? And then possibly sharing the Ad Revenue with the Company if the content gets claimed by the owner? Cause I've found some huge channels doing this method, whether it was a Top 10 approach or a E! News approach, it looks like all the content is just taken directly from these companies without any credits being given to them (Short clips of course) and they do present it in an educational way, but it is still all copyrighted material that's mashed up for a 10 minute video which is my concern with this entire strategy.

And then I've found YouTubers doing this another way where they mash it up with both their own unique content and then copywritten videos/images together. So it shows many clips of them talking in front of the camera about a topic and then it switches over to show video clips/images that are copywritten and that's how they mash it up instead.

You should understand the copyright first - copyright in short means that person have put an effort to create "something" so any benefit that "something" give goes to that person, it may be money,fame,etc. (something refers to original work)

Fair use in copyright refers to something done for good purpose without spoiling the "original work" revenue sources,fame,spoiling the original
Fair usage have no limitations but what should be considered as fair use comes here its based on lot of factors.(check with most famous copyright judgements in wiki)
Fair use kind of adding your own opinions, creativity, research,education, speech, spreading the good, reporting news,etc

If your intenstion is to make money out of the other creators effort it won't fall under fair use.


You can point out many channels taking the clips,films scene but we can't tell the real relationship between the copyright owner and the channels or the method they use to stay safe(method refer to black and white techniques)

Better create your own contents

as can be deduced from the previous comments, the guy that posted that video is frankly a douchebag.

He is trying to garner as many views as possible based on bullshit rhetoric designed to generate views and shares by inciting fear and panic in the viewers, who then want to "protect their friends". And it clearly worked on you.

I guarantee you, you and the guy who posted that video is well aware of the fact that what he's saying is complete horseshit, and that is about the only thing "cartoonishly evil" about it.

We will later find that this fine specimen of academic excellence had actually created this video as a component of his thesis project for his Master's in Douchebaggery. (Not) lol

But seriously, try to be more selective of who you listen to and take seriously especially on a platform we're literally anybody can log on creating account and, with little or no effort, upload anything they want saying whatever they want and have it in front of countless people before it is even reviewed or reported if dangerously inaccurate.
