The legality of negative SEO is questionable at best. I haven't heard of any case in which someone got sued for neg-seo their competitors. The problem is not getting sued, it's the ethics behind doing something like that. And even if you throw away the ethics, negative SEO is not allowed on this forum anyway per the rules!

Questionable? Depending on which country you're in and which strategy your attacker used, you can sue for defamation, copyright infringement, cyber crimes and even cyber-terrorism!

You don't hear anything about this in the news, as they're never being sued for using negative SEO - it's mostly extortion (through negative reviews for example).

Yeah I guess so. I am presuming DDoS is protected against by a combination of request throttling so each IP can't make an unreasonably large amount of requests as well as load balancing on the server side to handle very large capacities of traffic. In theory so long as you can provide more requests than the total capacity of the load balanced cluster than you can take down the server.

I did see a documentary about Russians exporting business owners this way. That's pretty damn nasty.
