I guess it could be easier to tell google about the infringement. Negative seo could be questionable from the perspective of law.

No offense mate, but nobody in their right mind is going to do nseo and agree to get paid only after a site is de-indexed...like saying, 'I'll pay you once you get our page to #1'

NO !

If the website is actually infringing (and I hope this is true and not just your tactic to ask for nseo), then report him - to google for deindexing and to the authority and/or sue him.

But don't ask for negative seo, which is not allowed on BHW (and is anyway never the best move in any situation).
