Need help filling W8 BEN form - India

    Hi,

    Adscendmedia asking to fill w8 form before get paid. I'm having problem figuring out which option to chose in tax treaty benefits.

    I'm from India and individual. I know last 3 option does not apply for me. Do I need to check first option or not?


    Claim of Tax Treaty Benefits (if applicable)

    I certify that (check all that apply):

    1)The beneficial owner is a resident of [the country specified] within the meaning of the income tax treaty between the United States and that country.

    2)If required, the U.S. taxpayer identification number is stated on line 6 (see instructions).
    3)The beneficial owner is not an individual, derives the item (or items) of income for which the treaty benefits are claimed, and, if applicable, meets the requirements of the treaty provision dealing with limitation on benefits (see instructions).

    4) The beneficial owner is not an individual, is claiming treaty benefits for dividends received from a foreign corporation or interest from a U.S. trade or business of a foreign corporation, and meets qualified resident status (see instructions).

    Not a direct answer but read this guide and you should have a clue. It's a good idea to fill in this pdf and save it on your pc in case you need it later.

    Thanks a lot for the help, Blakester. Will they deduct anything as tax, if I chose that first option?

    No problem my friend. I am not exactly sure but I think they may tax you when you reach an amount of $600 and they will tax you according to your country laws i suppose.

    Best thing to do is to send them an email :)
