I don't argue that the OP may loose it if it indeed is an obvious brand infringement, but I wouldn't fall for bullying through an e-mail.

That is such bad advice I do not even know what to say.

If the domain is a trademarked name (I assume the OP meant that as opposed to copyrite) the legal ramifications could be pretty ugly.

I tell you what; I've been on both sides of this fence and I know for a fact the OP will lose and will lose big if he follows the advice you are offering.

You are offering advice that will hurt him and that is not proper by any means.
 
Then I guess we agree to disagree. I've also been there and simply refuse to be bullied through e-mail or even by phone as it doesn't hold any legal substance.

Of course OP should check it with his lawyer.

If it is a trademark issue with a large company it only makes sense to give it up.

If he has adsense on that site, say good bye to the adsense account.

If he has CJ on there, that is also a lost account.

Amazon... bye bye.

Those guys will not want to be in the middle of a trademark infringement lawsuit and will drop you faster than you can say "home fries".

If the company wants to come after him, they do not have to warn him, they can just come after him and he'll be in a large pot of hot water.

Legal notification of "I can sue you" is not required in a trademark situation and the email is a courtesy call.

It depends on your site. If you are using wordpress, just google about migration wordpress to new domain

Of course I do not know more that EVERYBODY else, I do know what the OP should do here.

This is not rocket science.

If you were ever sued for trademark infringement or if you ever sued another for trademark infringement you would agree with what I am saying.

I'm not talking about getting an email or a letter in the mail, I am talking about a real life lawsuit... I have no dog in this fight, I just don't want the OP to be deceived into thinking that an email from an attorney that represents a client that has a trademark means nothing.

It is a courtesy call and nothing more.

They do not have to let them know a lawsuit is heading his way, they can just sue him and then he will be in deep sneakers.

It can be, I know a guy that lost thousands because he did not give up his domain when he received a courtesy email.

They closed his adsense account and took the thousands he had in his account.

Give the domain up and move on to the next project.
 
This happened to me before (silly bands) Just give up, or go offshore with bulletproof registrars.
 
so did you learn your lesson? theres far most awesome and safer ways to make money.

I am worried now my adsense will be banned.

I think i will contact them on the 31st so i can milk this revenue. I will then stall over emails but cooporate.
 
It's been mentioned a few times already, but unless you actually have a case to make against their claims AND have money to take into the courtroom with you, you don't have much choice but to concede.

I've had a few copyright / trademark infringement lawsuits aimed at my offline company, but we actually had a good case against them. We hired some good lawyers that stated our case strongly and after a few exchanges with their lawyers, we never heard a word back from them. If they pursued it any further though, I would have dropped out as I'm a small potato compared to their multi billion dollar company.
 
there is no question about it, i will concede as i am in the wrong.

my hope now is domain transfer and keeping my serps. all might not be lost :D
 
Hey, why are you panicking? Don't give up that fast, dowser is right that this email thing isn't valid anywhere. Although transfering your account offshore is a good idea.
I also have an idea. Why don't you offer them to sell the domain? Tell them it would save them a lot of money and time.

Are you sure about the email not ebing valid? If it isnt and my adsense account isnt in danger id ignore the email.

Also for you guys talking about swapping domains, if i swap domains and transfer the content will i need to keep the old trademarked domain for months to keep my serps?
 
I think i will email them on the 31st and ask them to forward me a copy in the mail of the signed contract they have to represent the company. This could be them working without there blessing and then they will show them results they have gained in the hope that they will employ them in future.

What you guys make of this tactic?
