MC999 warning , what to do to avoid trouble with court?

I just found this forum after getting a MC999 on ebay.de.
I found a lot of MC999 threads,but no one that is worried about court steps...

This is the message I got:

while checking your eBay account, we found that the forces of the eBay principle trademark infringement - have violated unauthorized offer. For this reason, we have taken on your account the following measures:
- Offers were removed. A list of the items we have , you will find at the end of this email .
- Fees for deals that were stopped prematurely because of the violation will not be credited to your account.

Your listing has been removed , because we are the rights holder has advised that it is a forgery in the item on offer . Please feel free to experience directly the rights owner why he has demanded the removal of your offer and whether you are allowed to relist the item .

This means no one has ever been prosecuted.

And the most thread you will find are of "How to get MC999 limit removed?" or "Where to buy a new stealth ebay account?"

So, go and get a new account and do what you were doing previously.

I bought on the inernet a few items for a cheap price,I thougt they must be fully legal.The products I sold are exact the same as in the local store.So I decided to start to sell them on Ebay.
I sold 2 items and had 4 item listings left when I got this message...

So what is de safiest thing i do now?
I'm really worried to get problem with the court.

I did this with my good ebay orginial +100 100% ebay account.I just confirmed my information on Paypal with Id and gas bill etc...So they have my information.
It happend on the german ebay and I'm not from germany.(dont know if this can help me).

If I have to lose the ebay account,it will be no problem for me as long as I not will get trouble in the future with the court or other claims.
Only sold 2 items,nothing more in the past or so.And they only removed the 4 item listenings left.

What is the best I can do?

I really have no invoice or other documents of the stuff.
I think I better can't contact them and let this go?

Dude do you really think you are going to get away with selling fake Adidas in Germany ??

You wont end up in jail but eBay will ban your accounts as quick as you can load them up. Take your merchandise to a sunday market and try and cash out.

Are you trying to sell the same article with an new EBay account?

Sell low risk items for 30 days THEN sell vero only as used auctions.

Easy. I have 10 selling fakes all with 100 limit. Easy 3k for the past 8 months.

Ebay would never take you to court over what you sold.

I very highly doubt Adidas would take legal actions against you over just 2 items that you sold.

If you are really that paranoid about the situation your in sell or give all of the fake Adidas items you have and make sure it has absolutely no trail back to you and then go out and purchase a bunch of authentic Adidas merchandise.

Then consult with an attorney and if they engage in taking you to court if everything you said is true they would have no proof you could then counter sue them and then they would be the ones in hot water.

What happened in the end???


if you get a mc999 by a vero agent Adidas,lacoste,Rolex or who ever
for selling fakes do you automatically get a letter/email of these company's suing them for damages. Or a c&d. As you don't see much of this on the forum.


How would they work how much you owe them?
