So if you voliate their ToS it's illegal?

In answer to your question: This is an SEO forum (Search engine optimisation) and the terms blackhat and whitehat (in the context of this forum at least) refer to the different types of SEO that we carry out and whether it is inline with the search engine policies (whitehat) or implimented with the circumnavigation of those policies in mind (blackhat).
The terms do not refer to hacking, cracking, scamming or activities such as ehoring that the same terms might represent in other forums on the internet (hacking forums for example).
