legality of using paydayloan affiliate ads?

    Hi,

    Wondering if someone could answer a question for me. I am not new to affiliate programs but new to using a payday loan affiliate program. Apart from a disclaimer is there any other legal factors to know when using affiliate ads of loan companies? I know the loan companies themselves need certain credit licenses but if your just displaying their ads is there any legal factors involved?

    Any help would be appreciated :)

    I don't know about Australia, but here in the U.S. I just slap an affiliate banner or link on my site and leave it at that. If my site is not the one actually collecting the applicant's information, then I don't have to disclose anything. If the visitor is interested, then they just click the link on my site and then they'll be taken to the affiliate landing page to register (and that site can worry about all the disclosures)..

    Now if I use an embeddable form on my site supplied to me by an ff network, marketing co. or merchant, then that form usually already has a terms & conditions & privacy policy on it, so I'm good to go!

    Thanks for replying :) I found out the answer (this is for Australia only!!) you have to abide by the terms in the "Consumer Credit Legislation Amendment (Enhancements) Act 2012" issues by the Australian FTC, basically you have to clearly state your part of an affiliate program and not the loan company and you have to put a "warning about borrowing" on your website with a specific warning written by the FTC stating where people can get free finance help if they are in difficulties.

    sounds all simple enough to me :)

    In all honesty you can get away with just links as an affiliate. But the truth is the payday game is changing a lot and a lot of witch hunting always going on in this industry. They are always looking for someone to tag for something.

    If you want to play in this space I would be a bit more cautious as it doesn't hurt to just copy and paste a privacy policy from one of the payday loans you are promoting and add it to your site. Another thing that I recommend is putting somewhere on there that these are partner offers and you are not the lender in anyway.

    I do this on my sites. It's easier to be careful then sorry in the payday game. These consumers tend to complain and want to report your site so you want to be clear you are not the actual lender.
