Hello guys, I have a quick question for you.

Quick question lets say there is a store named Henrys Hats and I decide they dont have a website and buy Henryshats . (c) (o) (m) is this allowed? If I go one step further and make a post on that site called: henryhat (not henrys hats) is this allowed?

Is Henrys Hats a national chain? (probably not since I would have heard about it) If not, and you are at least outside the same state, you should be fine. If you are in the same state, you are most likely still fine. At least come up with a good back story for who "Henry" is like some fictional character or a distant uncle in the about section.

Are you planning on reg'ng the name and then offering to sell it to them? If that is the case, perhaps separating yourself somehow by using an "agent" to solicit the offer.

There's a huge difference in registering the next Apple product and some mom and pop store.
 
Rule of thumb, if what youre doing creates confusion from customers point of view for being too similar, or in your case give the impression that you are henryhats when youre not, then you are breaking trademark, registered or not
