just registered some trademark names

    Lets say there is abbott and i registered 3 domains with their product name in it: ukproductname.com, usproductname.com, buyproductname.net

    Yes of course i want to hop on this product and sell generics shipped from somewhere. If i do not advertise the product really as theirs on the site will they still come after the domains??

    I would think so, because you are counting on the name of their product, to sell your product, so basically you are making money from their brand name, so they will come after you.

    Don't want to be the deal breaker here but be aware that they have registered them for a reason.

    Be careful, it's not guaranteed they'll come after you, but there's a chance that it could happen.

    That chance is even higher since you'r not selling the product that the companies have worked so hard to develop, promote and even registered to be known as a product of the brand.

    Caution is advised, there might be some other users more experienced then me in the field, but just wanted to leave my 2 cents on it.

    they will eventually sue u, and take everything u own...not being a ass about it, but that's ultimately how this movie will play out.

    I suspect these domains will get shut down if they rank highly enough for 2 reasons: 1) They impede someone else's trademarked product, and 2) They don't comply Trading Standards laws (e.g. using the site UKiPads.com and shipping fakes/similar products is definitely not allowed in the UK). You'd have to check other laws and regulations for the countries you operate in and from, but as a rule it's best to stay away from trademarked domain names.

    Do not waste your time developing those sites with openly trademarked names.

    I suggest you contact the respective owners, request that you wish to be an affiliate for them
    (which they will say no to) and then liase with their legal to get at least your reg fee back (plus a few $ if you are lucky)
    BUT MAKE NO MISTAKE, your domain will go to the owners, because they have will 3 aspects with which to win a case
    against you, and I would imagine they have you on at least 1 (if not all 3) counts.

    Do NOT work on those domains because it's not worth it.

    Thanks for your help :) But if i create just an informal blog about their product and then place banner to the page that sells the generic, would the circusdance be the same? After time the TM domains could rise in ranking and if they decide one day to come after them, there would still be the money site that is not using their product name in the url

    Once again i'm not trying to be an ass about it but that question can't be replied with 100% accuracy and here's why:

    1. The Brand is the legal owner of the product/brand name and brand product, but with that said, they aren't the legal owners of the domain you own, unless it's an EMD to the product, but from what i've read from the OP you added uk, us and buy to them so legally they don't own them.

    2. The company may not be interested in spending the time or the money to go after you, sometimes it's not worth it for them, which once again doesn't guarantee they wont. But from this point of view, if they created registered and developed all of the above mentioned (Brand, product, etc.) they must be able to afford someone to get to you by diving you bad reviews of bad SEO for you'r domains, it's BS to do that but hey you're hurting their business too so it's kind of "payback time".

    3. (This one is my personal opinion, you'll take it as you want it) You'r costumers will never be happy with you'r service, simple because you're promoting something you're not really selling, that's like selling fresh air, they will be disappointed and although you may have a few sales it will never be something that will last that much for long-term business.

    4. Are you really that interested in presenting, promoting, selling or whatever a product that you don't truthfully believe in? (Once again this is my opinion) I wouldn't be able to sell something i don't believe in, surely this is Black Hat, but still would you feel good about yourself by saying to a friend or a family/relative: "hey i'm selling fake this or fake that"? I wouldn't and even if you don't explain it to everyone someone will notice you'r involved in the long run (simply because you'r competing with companies that may have the money to do it)

    Hope I've been clear with my point and that this has helped the way you'r thinking, i'm not saying for you don't go trough with it (if you really want it you can) but I don't advise you to do it as most of the members here already explained.

    Good post meikibay.. but remember this is IM, usually we WANT to use someones 'good' name to generate clicks to our site, and we accept if only 3% of them convert. Using their productname in the url may provide a fast ranking edge over others. I think the best would be if i put blogs on these and treat them as satellite sites. And if they break tomorrow just give them up..i am sure once any of these domains reach 1st page they will be aware and may take action.

    funny thing i noticed when searching for viaxra or containing urls: there are almost none to find anymore LOL. i remember this was quite different some time ago

    I agree on the use of the good name of other companies, but that's being an Affiliate, most of the companies members promote by doing IM are legitimate and you need to sign up with them.

    But hey who am i to tell you what you should or shouldn't do? if you've already got a game-plan go for it.

    Just don't get the point of why you asked all those questions if you've already figured it all out in your mind, what where you trying to understand from it?

    I'm not trying to be a funny ass, just saying that if i knew what i wanted to do and i'd still go for it no matter what were other people's opinion i rather not ask instead of being defensive about it and making excuses on my own to try to justify it.


    We don't need to know why you will go ahead with it, if you want it, do it.

    Just remember that if something goes wrong there's almost 10 replies in this post from members that will have the option to say: "I told you so".

    Look up cyber squatting laws, and if you fall into that category then I would do something different. And if you have a trademarked name -- even with other keywords in it, then you may get into some heat. Just read some domain forums and you will see that there are millions of people with the same idea..
