Debit cards are different in terms of chargebacks and Section 75 compared to credit cards.

Debit cards It applies to all debit cards goods, although exact rules may vary between the Visa, Maestro and American Express networks.

Speak to your bank and ask them about Section 75 of the Consumer Credit Act 1974 and their policy for debit card transactions.

Issue here is the jurisdiction of the court to apply for this kind of case. I think the best bet is for the complainant is to go for Alternative Dispute Resolution (ADR). Find a lawyer in this line. He will file a dispute against PayPal on his behalf. The whole court proceeding is most likely to be carried out on video conferences call as agreed between his lawyer and PayPal's legal department.

I don't feel any other option can get him back his fund other than this. I wish him the best of luck.
 
Wish you luck buddy, but my experience says that F&F transactions are never reverted.
Once scammed, i never paid anyone against F&F. Sometimes, i have to bear the paypal fee myself, just to avoid this.

The money was sent as FAF ,They most likely have logs for his logins . Sending as FAF from usual logs doesn’t look fraudulent but intentional.
 
Don't let it go easily. Try everything to get the money back. You will win for sure.
 
Sorry about your loss op, but to me, cut your losses and move on. You are not likely to be successful. Besides you could damage your PayPal account.

F&f is not all bad anyway, if it's used with the right people. Several BHW customers have paid me with F&f because in my particular case, I can't receive PayPal in my country and I am not prepared for the hassle of a fake PayPal account (to which I have lost hundreds of pounds before to PayPal limitation). So if customer can't pay me with bitcoin I use a friends PayPal and since I can't have him take tax liabilities, F&f is the only way for me to go.
 
Anyone in the UK that finds themselves in my position in future ring ActionFraud. They take all the info and then log it with the police.

They gave me a crime number and I had to give that to PayPal and my bank.

I spoke to my bank then and they said that the payment has not yet been taken.

They told me to keep an eye out on my account and when it leaves my account to ring them and they will reverse it.

£107 came from my bank account so as it stands I'm going to be down £84.
 
you got prove that they wanted to be paid with friends& family. This could help explaining paypal your problem
 
once paypal money been receved to bank paypal will shut your account .

like they said famly and friend payment not revesarble

If you don't care about your pp account, file a chargeback request to your bank. If you present your case well, you will win it no matter what. Digital products are pretty easy to get refunded on. Let alone getting scammed.

I do care about this pp account. I don't want to lose it.

That's a no brainer bro... They would have lost money and someone has to take the rap for it.

Maybe the scammer account gets limited instead as the chargeback is being taken from his account.

I find it crazy that PayPal may limit an account of someone that has been scammed.

Happened to me once. I closed the case prematurely, then I couldn't re open it anymore. I filed a chargeback and paypal had to re initiate the case again. I ultimately won it so I still have my account.
Not sure what will happen to you. Paypal is a di*k u kw lol .

To PayPal yes, but he can email his Skype chat to the bank, show the guy has done a runner. And request his money whilst reporting fraud.

Before a scammer will be that bold to scam with a paypal account, its most likely either a fake or stolen account and the funds transfer mechanism out of the account would have already been in place. This means paypal won't see the money to collect from him. If you charged back, they will have to pay from their own funds..and that where the risk to your account comes in.
 
A quick update.

I just had the payment reversed by the bank.

Let's see if my PayPal account holds up or not.
