Apparently JC Penney just got popped by Google for a massive BH campaign. Check it out:

Nothing like some good old-fashioned American sensationalistic journalism.

Wow after reading the first paragraph in that article some readers might think that the New York Times is accusing JC Penny of breaking some laws. Leave it to the journalists to portray this as something more than it actually is.

JC Penney's SEO company might have been using some blackhat link building methods, but I didn't read anything they were doing that was illegal. There's a difference between ignoring the rules Google has in place regarding how it ranks the websites it shows in it's results and doing something illegal. The New York Times should be a little more diligent in how they choose to report the news.

Google chooses whether to rank a site or not. Creating backlinks is a perfectly legitimate way of receiving traffic by making your site known
    to a wider audience.
It's a bit like saying you cheated to get to No1 in the billboards because more people watched your trailer.
It's googles own methods of ranking sites that is it's own failure.
Google will soon become just a commerce search engine, people are shifting when trying to research and the only results
    they get are marketing sites.

I wounder whether JC Penny could sue the writer of that article for slandering their name by calling it illegal...
