It's funny that you ask if it's legal or not on a BHW. What is legal ? It has it's own meaning to everyone. It depends on the comment and how it relates to the article.

I would argue that I'm VERY passionate about commenting on blogs. In fact I'm so passionate about commenting that I payed for a program to blast out my quality comments across the web.

You are filling out a form on a website that is provided by the webmaster.

It would seem strange that something offered by the webmaster to a user would be illegal to interact with.

There is also an enforcement issue. Just because your site might be the one linked to, how would it be proven that you were the one that made those links?

The right question when using SB is : is it legal for akismet to ban your website from commenting on ALL wp blogs due to a single blast.

How could you police this? theoretically how can you say what is a spam comment or not? who says I cant say " Wow this is a great post! Thanks for this!"

Anyone can take action against almost anything and find some statute to back it up if they are so inclined. Especially in the United States, the litigation capital of the world.

The question is, who is going to really come after you for commenting on blogs. It would have to be a well financed blog, and you would have to be a severe pest.

I would imagine just trying to pierce the anonymity of a proxy would be a very expensive endeavor.

And if your not using proxies or through a VPS, should you really be using SB?

Probably not legal as it hampers freedom of speech, earning money and its unknown whether it was the owner or some other person that caused it.

Nah, it's not the litigation capital because in the USA only wronged parties may sue. Check out the legal circus in countries where anyone can sue anyone else just by witnessing the wrongdoing. You can literally sue a guy blocking a driveway which is not even yours.
