is this worth sueing ebay for?

just wanted to get opinions. if i should sue or just make a new account under stealth mode.

story:
sold jeans for $500. 4 weeks after delivery he opens dispute saying item is fake.
i never sold fake. 250+ feedback, 100% positive. never had a dispute for a fake.
funny he says it is fake because listing shows pictures of item and tags etc.

paypal tells me they will decide on the case in 30 days. i call company and guy "promises" to resolve in 30 days. 2 months later case not resolved.

i call paypal tell them whats taking so long? they say they will resolve it by tomorrow. so tomorrow i get email saying case resolved and buyer can return jeans for 100% refund.

this is a very expensive brand. ebay policy is for fake high end items, buyer is required to get 3rd party documentation (means take clothing to store and get letter from store saying it is fake). i think some bast*rd just was like "oh sht time is passed lets just make him return"

i call paypal and tell employee this is not what the policy is and every time i bought a fake i was required to get documentation. employee 100% agrees and says "you are right, don't worry i will put the case back into review"

but the dumba** at paypal doesn't send buyer email telling him they are going to review the case. so the only email sent to buyer tells him to return jeans for 100% refund.

buyer returns jeans to me and gives tracking.

i tell paypal this is not policy. something wrong ---> report ---> if they accept than return. paypal tells me "too bad he returned it he has to have a refund".

ok not a big deal i have jeans back and i can resale if i lose a few dollars not a big deal.

but they block my ebay account. my paypal 100% works but they block ebay.

i call ebay and they said they blocked it because i sold a fake. i told the lady paypal never required documentation i can forward you the email of the decision. ebay lady says "i doubt that, i know for these cases they require proof." than she says "well it doesn't matter, i am not doubting you, but even if that was true, i have no way of knowing the case details since it was opened on paypal. the only thing we have is (1) the item (2) the reason, in this case fake item (3) the decision they found on buyer favor"

i had about 40k listed on ebay.

should i bother with lawyer and suing or just make a new account?

same opinion here also. You can't win against big companies if you're just a regular person. If you are represented by another big company, you can try.
 
if you are in the UK, you can threaten to take them to trading standards... if you are not, then you will probably waste your time suing them.
 
It doesn't take as much money to after someone as people make it out to be. Sue the person, not eBay. With proof that his lies greatly affected your sales, you shouldnt have any problems in winning.
 
it's not the person's fault. it's ebay's fault for handing the case. i even had another ebay supervisor tell me that decision was wrong and she would escalate the case, but noone bothered to email the guy.
 
Do you have enough money to sue? If it were me, and I had the money, yes...I would sue. Why? Because they most likely wouldn't bring a rep to the case, and you'd win by default...or they would try and settle out of court.

I used to work in HR for a company, and we got sued A LOT. Almost every time we'd lose because no one showed up from corporate. Most of these cases were in the 20k range.

That's my opinion. I am not a lawyer, I've never been to law school. This is not advice and should not be taken as such.
 
Gosh that's too bad it happened to you. Maybe you can write a letter to one of their executives. Let them know your a long time seller on eBay and include all the documentations. See if they will correct their mistake.
 
I think that you should try suing them. Maybe they will throw a settlement at you...
 
ebay SUCKS man!

You have no choice but to keep buyer happy, that is all ebay cares about.

Dude if buyer says unhappy and wants to ship back you have to do it and refund or else you will fail on ebay. Sucks but that is the way they want it.

Heck sellers can't even leave negative feedback anymore, that should tell you where ebays loyalties lie.

It sucks but these types of scenarios are the price you pay for doing business on ebay.

My advice is drop ebay, start your own ecommerce site. Invest in some seo, youll be making way more money than ebay. Peace.
 
I'm sick of eBay's BS. Maybe you should make an attempt even know its impossible but to rove a point.
 
Ebay and Paypal suckkkk. The amount of times similar things have happened to me. iv had 3 accounts stopped from selling indefinatly for things that arnt my fault. You cant beat them there is no chance. it sucks i have about $30k in stock that i cant move now until i make a few websites and get them ranked high enough to make some sales. its inconvenient
