If I am promoting a CPA offer for a Best Buy gift card, is it legal for me to print off flyers with the Best Buy logo etc.? Even though they are obviously ok with the promotion itself, the website that I am promoting is the one with permission to use their logo etc., not me.

Best advice would be to check with your aff manager if they are OK with it.

You are not going to BestBuy itself and then hand these flyers out, are you? That will surely be frowned upon.

OK, I am NOT getting on your ass here but when was the last time you did anything with a flyer found stuck under your windshield wiper but give it the toss?

I can think of nothing less effective than hiking through a WalMart parking lot hanging flyers, which will result in WalMart security telling you to pick up all your flyers and then to hit the bricks. Were I you, I would think of something more creative like free ads on CL or Backpage. Far more effective for sure and you haven't wasted all that printer ink and paper.

What makes you think bestbuy is ok with their giftcards being associated with incent offers, and what makes you think the incentive site has some sort of permission to use bestbuy's trademark?
 
Flyers work if they are used correctly. Putting them on random windshields is the offline equivalent of spamming - when was the last time that converted?

You guys are not in the mindset of the walmart customer lol, you're in the mindset of someone who advertises themselves. Of course you'll see the ulterior motives of an advertisement... you're in the game. But think of the average almart customer, low prices, free gift card at a place they just shopped at... From a parking lot of the establishment, it could convert very very well.

As for the legalities, they're not going to track you down because of some fliers, staff might pick them up and throw them in the trash but if you think an investigation is going to be carried out you're an idiot.

The posters got detracted. Legality can be a major issue first than effectiveness.
Have you inquired about it from your aff manager till now?
 
It's really up to your network. Some will suggest it. Does your network have creatives?
