Is this is D-bag move? AITA?

I have a competitor in one of my niches. This competitor uses some shady tactics to get ranked and the website sucks. I am not the Google Police but damn Google why is he ranking?

Long story short, I noticed that the webmaster posts new articles but forgets to fetch them so they are posted and not as of yet indexed. Would it be wrong in this case to take the un-indexed fresh article and post it to medium.com for a quick indexation?
