Is this illegal?

I wanted to try a method.
You have to use a 'hot' girl on your facebook profile. But is this illegal, like identity theft?

Might be if you're using copyrighted material, but in all there are thousands of accounts like that. If you want to ask if you're going to be caught, you would have to be one unlucky mofo.

Im pretty sure that's not what identity theft is. Im not sure if its illegal, but the police/feds are so far behind on MAJOR cybercrimes, stuff like this isnt even on their radar. I see ppl getting legit scammed all the time and those ppl have no chance of being caught let alone some guy pulling a catfish on fb.

In Finland its not illegal beacause our law doesen't have thing called identity theft..

lol yes its illegal in that 99.9% of people are using copyright infringing photos and non 2257 compliant nudees etc.

If you're worried, spend $50 on some legal image sets that you own the rights to and know they are 2257 compliant...

It might be illegal but the amount of risk depends upon many factors such as your real jurisdiction, what extent you go to, etc.

Not at all pal.. portraying as someone else and posting their pics along with using thr name and posting on the person's friend wall is.. random name and random pic doesn't make much echo..! I see thousands of such examples everyday basis on Facebook which are hammered for spamming by Facebook sooner or later..

In Brazil it would be illegal...

What you've described is more a case of copyright infringement. The person you took the pic from owns the rights to that pic - BUT the chances of that person finding out what you're doing is pretty low - and even more so if done smart. I purposely search for ppl in different countries or different sites for pics that I use - so the likelihood of them, or someone they know finding them is pretty low.

I think he could face two kinds of charges. A criminal charge for identity theft and a civil lawsuit for violating the person's right to their image (not sure if this is the english term).

Okay , its only identity theft if : you are using the girls credentials as well. That girls actual name birth date etc. or using info's to transfer out of her account (s) It is ok on fb to use avatar that is not you , unless you uploaded to self portraits a pic that doesn't have your face, but , that is : a hyper specific non enforced fb rule.

The same person making multiple accounts through separate emails is a big fb no no. A strict rule with them , for sure. However , at this point , only violating fb rules heavily , not yet technically law breaking.

You have the benefit of the doubt of being : just someone who saw a pretty pic they liked and used it as an avatar , and not understanding fb rules about not making alts.

The illegal comes into place when/if : you are using that account to make adult content referrals.

Long story , my first thoughts of online money involved : adult content. My research was in the understanding of adult content rules. You need docs and permission for any person appearing in adult content OR promotion thereof. This law is similar in many countries.

Photocopy of a picture id for the model appearing, and proof of permission.

The only way this rule is bent is if : the site your affiliated with gave you a stock of images , then the liability is on them.

I know Facebook is a big all encompassing soul eating site , but , they don't have any more legal authority than any other web based services. Its the same legally as trolling a minor message board/forum site.

It's a grey/black method of lead generation, but it's not considered as illegal/fraud at the moment.

It is definitely not identity theft, depending on who owns copyright of the picture you could be sued for using without permission, which can amount to quite a few pounds/dollars

There are many sites offering free images and you could probably find something suitable on one of them without the worry of anyone complaining.

Do yourself a favor and buy a model set.

You might wind up using a picture of suicide victim, and then you are the devil incarnate, and the whole internet will hate you.

Buy your images people, they are cheap.

its a grey area. Some places have new laws regarding fake social profiles.
