Is this illegal?

Hey guys, Im new to BHW but I have been searching here being quiet for the past little while. I have a simple question.

If I were to make a file available for download to the public, that when downloaded, makes a process that runs in the backround of there computer and access a site. When the process/bot gets to that site they are givin a script to execute. This process would not touch any private files on their computer but only use its CPU usage, internet and IP address. It would also not be used to make botnet attacks on webpages.

Okay, I know many of you are probably going to say "if you have to ask its not a good idea." but im seriously wondering because it doesn't seem to violate any laws I am personally aware of. Of course I could be completely wrong.
 
would the individual downloading the file, made of aware of the implications associated with this file or is it a covert operation. I would think that it is illegal to have software doing backdoor operations without the knowledge and permission of the owner of the computer.
 
it's exactly sounds like making a botnet, even if you state the opposite

i'm not a lawyer, but i found your plan troublesome at least in two points:
1. you're not allowed to plant such things on somebody else's computer without he/she is agreeing to it
2. using somebody else's IP address doesn't sound too legal either
 
It is same as asking weather it is illegal to make malware publicly avilable.It is not legal but no one is going to hunt you down for it since it does no damage.But today anti-virus would probably detect it.
 
What you are talking about is called malware and as far as I know it's illegal in many countries. Microsoft's definition of malware:

Malware is short for "malicious software." Malware is any kind of unwanted software that is installed without your adequate consent.

No consent = illegal.

Sorry to use such a vulgur example but imagine a drunk women who passed out on your sofa at a party at your house.. now if you were to have sex with her or do any sexual acts on her that would be considered "rape" hence "illegal" because she would have no idea what was going on due to having no knowledge of what your doing to her (apart from the obvious being passed out).

But yeah lol.. in lehmans terms definitely illegal :P.

That's up to you to find out, this forum is not for wannabe hackers or malware developers.. Black Hat doesn't necessarily mean illegal. It's also against the forum rules to discuss stuff like that.

................. Connecting to people's wifi without their consent is illegal. Of course planting a bot on their computer would be illegal, too.

My CPU was expensive, so was my RAM and my motherboard, hell, my gfx card, too. And the case and the monitors. The DVD-RW, not so bad, but many other expensive accessories. Not to mention the connection.

......... So if you ask somebody like me, you are stealing. You are stealing my resources, my CPU power is a resource that I use frequently (believe it or not) and unless I consent for you to use it as well, you're stealing from me.

Well im not going to do it anymore, guess I should have thought it though more before posting on here.

But for the discussion, to m4dm4n, couldn't you just post like "This program is going to send all of your credit card data to the owner of this and it is there right to buy things on them."? Like i know that for sure would be illegal, but just because its posted in the TOS doesn't necessarily make it legal. Unless I'm not getting your pt.

NO ONE reads tos unless your a lawyer lol

No lol, I was thinking about running Firefox in the background and running viewtubetrain to increase views for videos. Not sure how it would work. I think the site is a pretty good idea to get traffic to your videos though.
