Is This Illegal??

    Hey Guys, Quick Question...

    Lets say i join a certain affiliate program, who sell something of a brand name item...for example lets say.....mamas and papas, they are a major store here in the uk.

    Would i get arse raped if i created a site like mamasandpapasforkids.com, and i sold their items on it??

    Is this copyright or what?

    There would beno problem at all as long as you are selling there stuff not a copy of there stuff .

    You should ask them. If you go and just do it without asking you could get in trouble, but if you explain first that you'll be using it to sell their stuff they will probably be open to it.

    I'm not really clear on how things work over in the UK, but if it's anything like that US, I would definitely say so. You are using their brand name in a domain for profit, which they could just as easily do. If you kick around the forum, there's a bunch of threads out there basically asking the very same question, or stating that they did this and received a cease and desist from the mentioned company. There was someone posting recently about doing this with Facebook, and he got a C&D notice from them.

    What if you got the domain anazon.com, and just linked people to Amazon product pages, they wouldn't be too happy, would they? They'd want you to stop, and I guarantee they have some good lawyers.

    You could use the site and hope they never find out about it by taking precautions such as a double meta refresh or some kind of magic number system and pray that "Mama's and Papa's" doesn't stumble across it.

    I'm no expert, just going by based on what I've seen around here.

    Yeah its going to be their stuff only so i wasnt sure....

    What if i forwarded the said domain to another site??

    You will need rights from their company to sell their products.

    You should ask permission first to the owner of the website. It is for you to be in the legal side. :)

    I don't know???? If you are a affiliate of the store, they why couldn't you buy a domain like that and then sell their stuff and get ur commissions..... if they didn't want you using their info in a domain it should be their TOS..... example....if i am macy's owner then i would try to buy every domain that is profitable with my companies name in it. like macysclothes.com.info.org and so on.....
