Is this illegal?

The minute you contact them, they're going to think you're making money off their brand and get angry.

If they're big enough to have legal representation, you're going to find yourself at the receiving end of a Cease & Desist.

If they're big enough to have a following, but not big enough to have a lawyer - you're going to be on the receiving end of a message to their followers saying that you're selling unauthorized versions of their materials.

You would be better off registering their domains and before you try to sell anything on it, contact them and ask them if they would like to buy the domain or potentially partner on a merch deal where you take care of the product, site, hosting etc. And they promote it. In exchange, they get 70% of the revenue and you'll take 30%. That's a very attractive offer - and they might be willing since they don't have to do anything but promote the store.

In all fairness, as long as you contact them and take their permission / establish a partnership BEFORE you start selling, then it should be all good
 
You can get sued HARD for doing something like that.

Remember, you're trying to capitalize on the personal BRAND they have already built up - they are, after all, influencers.

I do not want to sell anything or promote anything until we have written up a contract, the only thing I would be doing before contacting them is holding the domain. I just want to have a nice offer in front of them before asking to partner so they understand I mean business.

Regarding domain registration issues: Be careful. Make sure they haven't trademarked their name. Make sure what you're doing doesn't cause some sort of confusion among people who already familiar with the personal brand of the people you're soliciting.
 
It's still risky. As @VSYNC wrote, if you register their name as a domain and contact them with an offer to sell, they could claim ownership. If THEY contact YOU (for which they have to be aware of the domain in the first place), there are still ways for them to force you to hand over the domain. I know from experience (I helped my old employer get several domains that were registered by other parties hoping we would reach out to buy them - we just took them). All in all, you have to rely on them not having a lawyer or being very naive.

At least you won't have much to lose if you only buy the domain.

Like you put all your time and efforts in building your own brand, work hard to get the audience attention, develop useful relationships with other businesses and then all of a sudden someone tells you - hey, let's share the profit because I registered the website with your name on it. Would you agree to such offer? I really doubt that.
 
It'd be better to hit them up before you set up domain names. With a neat pitch, you'd be able to do it with their consent and split the share. If you do it the other way, they'll turn down the deal.

yeah, I agree just seems hard to get into contact with these people. maybe it was the pitch I used or the fact that I'm not a full-fledged business but I've attempted to reach out to roughly 40 influencers in the past and it went no where
 
This is a very unique idea if executed properly. I even kind of feel like you shouldn't have discussed it publicly. Art of Deception is the key.

I agree but at the same time Id like advice from others... I have very limited skills by myself but with the advice and knowledge of others i think it could be done right

well maybe this is the right time to hone your craft, master your negotiation skills and show these people what you are capable of, because honestly I think people who gained their popularity WITHOUT the website wouldn't buy into your offer unless you bring something really valuable.

Of course not but why do you the a person has Empathy to look from someone elses point of view. They just want to take all their money because they registered a $10 domain name. THousends of parasites have done it and thousends more will
 
I think it is how you sell it.
Here are my thoughts.

As long as you make the websites only as demos, for them to check out before they make a decision if they want to collaborate or not, you should be ok.
That could make you look good in their eyes. But, you should make it extremely clear that you are not selling anything and that is a demo site.

This leads to taking into count that some websites won't make you money. As some will refuse, your work and money spent are gone.
If you risk selling on them without their permission, they might sue you.

At the same time I imagine some will be offended anyway.

Maybe a middle way would be to make some sketches with the website and the merch that you would produce. This way you would work less and there is no need to buy a domain for every influencer you want to contact.
You can simply host this as a subdomain on one of your domains.
Just put 'demo' on every image/ design element, so they don't freak out too much.
