Hi,

I have been searching online to find the answer to this question, but I have not found it yet.

Any help would be appreciated.

If a site has links to movies hosted on places like novamov, megavideo, etc. then would that be considered copyright infringement on the site's part even though they aren't hosting the material?

Example:

MovieWatch.com (fake) has all the new movies right out of the theaters on their sites with links to the sites that host them.

Is MovieWatch.com then breaking copyright infringement laws?

If you have informative / authoritative links to back up your statements, that be great.

i've always been unsure how this works too. i plan on seekings the consulting of a lawyer once i have the money about stuff like this. if i do i'll try and share (won't be anytime soon) in the meantime hopefully someone has a good opinion
 
I have a friend which for years is running these kind of free movie sites, linking to a "upload files" site hosted offshore, we are in Europe and he has no problems, maybe this can help. Still no official info from my side.
 
Its not copywrite infrigement, but if you want use Adsense on it, I suggest you to contact them before. For other networks you can add a disclaimer on the footer
 
it's still copyright infringement according to some courts. It is so because you are "encouraging" the infringements by linking to it in the first place. There is no great way around it if you live in the U.S.

Therefore, even if you don't host it, don't link to it, etc. just having a site that attempts to offer any movies or shows for free is an infringement in itself because it is encouraging people to download it or seek it out illegally.

They could always tack on theft or accessory charges as you are in collusion to steal the movies rights holders out of their returns.

Think about how you would feel if someone did this to your website. Same thing......
 
Yeas its punishable offence.
publishing any movie including pirated or original is copyright infringement.
 
To sum it up - do not do it, unless you can cover your tracks - including domain, hosting, revenue collection etc.

US would be the worst of all jurisdictions, as you'd be stepping straight on Hollywood's Big Boys' toes in their own back yard.
 
yes it is still copyright infringement or it's at least considered as if you were promoting it.

All the top sites ran like that and were still seized.
 
There are still these sites running. I use one a lot. Your host needs to be off shxre or in bxllet prxof country. It technically is not illegal to link to it. If you live in the us, don't bother. Anywhere else, and you are much safer.
