We can discuss definitions all day long, it won't make too much difference.

When OP asked about "email spam traffic", he meant unsolicited, non CAN-SPAM complaint mailing, which is not legal, therefore not allowed with the vast majority of offers, hence he's asking. That's what spamming means and always meant on a blackhat internet marketing forum. The kind of mailing, which can get you in trouble with the network, with the law or with both.

What you were doing is not spamming, it's CAN-SPAM complaint bulk email marketing, which is perfectly legal.

The main issue is that definitions are getting mixed not just in your head, but in that quote from the court you posted too. They use the term "spam" as a synonym of commercial email and bulk messaging, which is obviously not right. Not too big of a surprise, courts often doesn't have too much clue about things related to the internet. Spam is the type of bulk mailing, which is illegal. Bulk mailing is a broader term and there's a legal part of it and that's exactly what you were doing, but that's not spamming.

And we're back to square one, that your definiton of spam is wrong. Saying that spamming is legal is a bad advice and will only make OP lose his earnings or his account on the network.

CAN-SPAM compliant bulk mailing is legal, spamming is not.

I'm with multiple networks who allow it.
 
No one has ever gone to jail for sending spam, or fined for sending spam. They were either sending email (it doesn't matter if it is spam or not spam) with False/deceptive headers and committing fraud or were sending emails without a method to "opt-out". There is no requirement that you need to get someones permission to email to them. There is no "opt-in" requirement under US law or CAN-SPAM. Because there is no law that says you can't send unsolicited commercial email it is therefore LEGAL to do as long as you comply with CAN-SPAM. I noticed you were not able to find the law that says spam is illegal, so just give it up and stop spreading mis-information/anti-spam propaganda.

There are plenty of major networks that will accept spam as long as you follow the law. I've been mailing for over 12 years and have earned millions per year in affiliate commission via bulk emailing. As long as you comply with the CAN-SPAM act (no deceptive headers/allow people to opt out) you will be fine.

The can-spam act is often referred to as the "You Can-Spam Act". Why? because it does not prohibit spam, in fact it makes it legal.
The backronym CAN-SPAM derives from the bill's full name: Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003.

I'm sure this gal bizzybut isn't making anything from spamming she once made a claim that they made $100k in a month from mailing. When asked to back it up with proof they dropped the ball and didn't back up anything. Seeing their ignorance about the can spam act just confirms even more they aren't too bright.
 
Sure they are a lot of service providers that allow bulk email sending.
But I recommend cleaning up the database first or doing a small test to check if the email exists.

The market for mass spam emails is getting smaller and smaller now, as fewer people check their mailboxes.

It prevents states from outlawing spam because the federal law supersedes any attempted state regulations. Retain any spam laywer and have them explain the law to you. Although I doubt you'd be able to afford that.

What you mentioned were ways to send ILLEGAL commercial email, which applies to both Spam AND Optin Email. SPAM is a general term, defined under US law as simply Unsolicited Commercial Email, which is not outlawed or banned in the United States. If you Send Optin Email - NOT SPAM- with False header information, Guess what, that would make your Optin Email -Not Spam (remember)- ILLEGAL.
 
Those methods are ways to send spam and will never be legal. I could be mailing to an opt in list or just a scraped list it will always be spam. I could use an opt out link and a physical mail address and still use those same methods to send mail and it's spam. so spam is illegal bro it's not legal OK?
